My question involves labor and employment law for the state of: California.
I recently did a job application for a employer and in the background check there was an area that said: You don't have to disclose it if you successfully completed probation.
Therefore I did not disclose the DUI, because I had completed the DUI program. However, I got my report back because I requested a copy and it says there is an inconsistency because I did not report it. Here is what the report said:
Violation: Driving without BAC of .08 or more
Code CB03
Conviction end date: 10/14/2011
Suspension: Suspension or revocation for DUI or speed contest
Code: DB31
Conviction End date: 11/10/2011
Restriction: First Offense DUI program
Code: UE08
Conviction End Date: 04/10/2012
Is this considered lying, even though it said I didn't have to disclose it?
