Several months ago my wife and I took in her purportedly very sick brother to our owned home. He does not appear to be able to work, has no income, no car, no other family and had nowhere else to turn. We are helping him figure out exactly what is wrong with him, via the Medicaid medical world, but it is very slow going and things have reached a boiling point in our home. Regardless of how sick he may or may not be, or how much he can or cannot work, we would like him out of our home at this point.
He has not and does not pay rent or utilities. A portion of his food is paid for via a 'state aid' debit card. Doctor visit co-pays and pharmacy bills have been paid by us. What would be our legal process for 'evicting' him, and what legal recourse might he have against us (to stay)? There have been no payments, no written contracts, nothing.
Do we need to write up a "you can stay until such-and-such date" agreement? And if we do, what happens the 'day after' the final date?
Do we need to serve him with an "eviction notice"?
Do we need to document "why" we want him out?
