    Default Can You Change Your Child's Last Name to Your New Husband's Surname

    My question involves name change laws in the State of: TX. My 11-yr old boy wants to have my husband's last name. He currently has my maiden name. Will I need to get a lawyer or can I file the petition myself? If I can petition this myself without the help pf lawyer, does anyone have any tips to share for me to make this as smooth as possible?

    Is your husband his father and he was born out of wedlock? If not, you will have to get permission from his father.

    If you have consent of the father of record, then it's straightforward. You both fill out the order, etc... (http://texaslawhelp.org/resource/chi...ions-english-s), notarize and file it. You'll get a court hearing. The TFC still requires the judge to determine it's in the best interest of the child.

    If the father doesn't agree (or isn't known), you've got additional steps of actually serving or publishing.
