Thanks for response. We are in our 6th month of a 1 year lease. The only notice I received was posted to my door when I came home from a vacation posted date July 6 and was what they called a courtesy letter stating they were getting complaints of domestic issues and our pet cat attracting other cats and if problems were not fixed they would take further actions. We just ended up getting rid of our cat since we couldn't do anything really if she was inside and still blamed for other cats around complex. Haven't had any other notices till other day Sep 8 when landlord gave us the letter from the office sent to him on Aug 25 stating that we were sent a courtsey letter July 6th in regards to domestic issues and they have been receiving several complaints and seeing our unit again in security reports, asking him to terminate lease and if have not vacated in 30 days they will take legal action. On Sep 9 a 30day notice to terminate rental agreement was taped to our door by landlord. I been doing some reasearch and looks like this isn't a legal eviction procedure. We never received the 2 7day notices needed to terminate lease for material noncompliance or never received a 3 day notice for a substantial violation and were never gaven any specifics of issues like dates, times, or details of anything done wrong just told of complaints of domestic issues, leaving us no fair chance of addressing issues or proof that this is true. I also read issues that are serious in nature and considered crimes need to have more proof and details of incidents and should have police called out to address when incident occurs. These measures were put in place to protect our rights as tenants as it is to easy to evict someone for something they didn't do and if not done so the tenant has grounds to receive damages of 2x their rent amount. Example if landlord says a tenant is selling drugs he can not evict tenant without proof and calling police. I feel like my situation falls into this scenario especially since there are claims of several complaints in security reports but security is telling me they have no complaints about our unit. Does what I have put together in my research so far sound like a good defense and maybe grounds to receive damages? I feel confident enough I could fight this myself without lawyer in court and feel like it's solid enough to win but alot is at stake for my family in doing so, so I want to be sure. On contrary alot is at stake also in not fighting this. Any opinions so far and/or suggestions for my situation please let me know. It would be an awesome feeling for me to be able to stand up and fight for my family and beat the ones trying to take the rights, livelihood, and what we worked so hard to get right out from under my family's feet! I'm willing to put my all to come out on top.
