    Default What are the Chances of Getting an Interstate Probation Transfer

    My question involves criminal law for the state of:
    Louisiana and Washington

    Trying to figure out what my chances are for getting approved for a Discretionary Transfer. I know its up to the receiving and sending states, but I can't find any info online of people reporting there experience with the process. Just people reporting obvious problems (no job, no support, long records)

    About my Case:
    Charges: Possession w/intent of Psilocybin (Mushrooms)
    Sentence: 5 Years Probation/10 Years Suspended
    No Criminal History besides this crime

    I was sentenced in December 2013, and started reporting for Probation on January 2014, so I'm about 19 Months into it.

    I've completely paid off all Court Fees, Attorney Fees, and everything else
    I currently pay every month for Supervision (around 60$ a month)
    I've never been required to take any type of Urine Analysis, and I wasn't ordered to do anything extra for my probation (go to classes, rehab)

    I'm so "Supervised" that I got a new probation officer 7 months ago and no one at the probation office even told me. They literally have showed up to my house one time since I've been on probation. I haven't even met my new probation officer, but she sounds extremely nice for a PO from the phone calls we've had.

    About myself a little:
    23 years old
    Had the same job since sentencing
    Haven't moved or caused any trouble since I was sentenced

    I'm requesting a transfer because I got a job offer in Seattle, and its an amazing job that I really want to take.

    I have proof of employment there
    I have proof for a living situation (Sublet, and Subletter can completely verify living situation, provide letter if necessary)

    So what are my chances here, seems like I have everything they could ask for? I'm only asking because I haven't seen anyone reporting on an actual successful process. I'm seeing 45 days max for an answer, is that from the time the receiving state actually receives the request? How long could it take for PO and Govt of home state to actually send the request?

    Probation transfers for those in good standing is usually straight-forward when asked for in advance of moving. Your existing state will need to send your information to the new state and the new state will send back what they will do with you. When your existing state approves, they'll send it back to the new state. You may get approved to move while all this is pending.

    Your first step is to talk to your PO and make your case.

    Really I could get approved while the process is pending? I thought one of the biggest issues was not being able to move until the process is complete? Wouldn't my state telling me I could move before it was over upset the receiving state?

    I've seen in happen, it's up to the state that you're reporting to. I've got no experience with the two states you have involved, but I've seen it happen in other jurisdictions.
