My question involves labor and employment law for the state of: Texas
I've resigned from my position and my last day was September 3rd, 2015. We had verbal; and email communication with our CEO and HR person, that how many unused vacation days I would get paid for. I've got the email where our CEO instructed HR to include certain amount of unused vacation days in my last pay check, and pay it out on my last day in the office. I've received the last pay check on my last day, but "conveniently" used 50% less hourly rate. I've voided the check, made a picture of it and gave them back. Now they say they will pay me at the end of the month at the next scheduled pay time (last day of September).
I know that if I resign the last paycheck is due at the next scheduled time (end of the month in my case). Our company policy manual does not specify the date.
Does this email communication and the fact that they gave me a check creates a defacto agreement about the last paycheck date, in which case the last payment is due now?
