    Default Non-Custodial Parent Requests Visits After No Visits for Over a Month

    My question involves a child custody case from the State of: California

    I am the father of twin boys which I have had full custody since they were a year old and now are almost 6. The mother and i share legal custody. This court stuff has went on and on so much back and forth stuff its ridiculous. The mother has received very little visitation(court ordered) and of course its been modified several times under ALL the circumstances. We were in court in July requesting to relocate. I wanted to relocate closer to family and for better job opportunities. Non sure what the mothers reasoning was. The judge told us both that neither one of us were going anywhere until we finished some classes he wanted us to take and the boys had to finish some counseling before the judge would even consider. I have done all that I was asked to do. So in the mean time he ordered visitation with mom would be every Wednesday if she wasn't working from 4pm-7pm and every other weekend from Friday after school till Monday Morning after she sent them to school. Receiving party pick up from others parents residence for Wednesday visit. Now our next court date is the end of September. Mother moved up north 14 hours from here 3 weeks ago. She has not made her visitations in almost a month and now says she'll be down Next Wednesday for another court date with another father and is demanding she pick up the boys from 4-7pm? Not sure what to do here. She already has not complied with the current order. Also she has no residence for me to pick up the boys like court states. What do i do? She plays so many games, never goes by any order and its just tiring. I feel the minute she moved 14 hrs away she cut her visits off then.

    Have the boys ready for Mom's visit. Visitation is a right, not an obligation. You can pick up the boys from where Mom is staying. The orders didn't change because Mom has moved. But she can elect not to exercise her parenting time.

    I understand that. The thing is mother moved and lives 14 hrs away so picking up at her residence which is what the court order states pretty much doesn't make any sense any longer. She has asked me to just let her drop them off because she will be doing" something in Victorville" with them(35 miles away). Thats her way of bringing them home late and kinda doing what she wants and that is why the judge was pretty heated with her last court date because the law to her just doesnt matter. I suggested that she visit with them in town I mean her visit is only 4-7pm. Im just trying me best to do what the court order says because I know this judge has just had it with things.
