    Angry Can a Business Impose a Trespass Ban Even if You're Not Criminally Charged

    My question involves business law in the state of: NEVADA

    If a LLC detainees you in a holding cell for violating no crimes and then calls the police after the fact to trespass you. What statues can I use to sue said LLC.

    First, you are told not to use personally identifiable information when posting.

    Second, you can be trespassed from a privately owned business so long as it is not for an illegally discriminatory reason such as race, gender, etc...

    Third, you would have to speak to a local lawyer with whom you can review all the facts to determine if you have a basis to sue. I would caution you not to post further details here as your name would be associated with them. This can, and has, come back to haunt people.

    How long were you detained by the business and for what reason? Was the reason because you had been warned not to come to the business before this so that you were committing criminal trespass? And what damages, if any, did you suffer as a result of what the business did?

    Note that generally there won’t be a statute that would apply here for which you would sue. Instead, if the business held you wrongly it would likely be a tort of false imprisonment,the details of which will be governed by state case law (court decisions). But in order to recover anything in such a lawsuit, you need to have suffered some kind of damages that the law recognizes, like financial loss or physical harm. Simply being inconvienced wouldn’t get you anything.
