    Question Can You Get a Psychiatric Diagnosis Removed From Your Medical Record

    My question involves medical malpractice in the state of: Michigan.

    Earlier this year, a psychiatrist issued upon me a "diagnosis" of Bipolar-I, even though the DSM-5 criteria were not even close to being met! And he did so without asking me any relevant questions and without an intake evaluation by a psychiatrist.

    I sought out a second psychiatrist, but he refused to "second-guess" the first.

    Now, I'm not actually planning on pursuing a malpractice suit, since doing so is incredibly difficult and almost never succeeds (especially with psychiatry). But I emphatically wish to see that bogus "diagnosis" retracted and purged from all my records.

    What options do I have?

    What makes you qualified to disagree with the psychiatrist? There's no snark intended - it's a genuine question.

    You're also asking a question in a vacuum - you mention no evaluation, but what were the circumstances? He did actually see you, yes?

    If the psychiatrist is subject to the requirements of the federal Health Insurance Portability and Accountability Act (HIPAA) then you have a right to request correction of your records. The U.S. Department of Health and Human Services (HHS) has a short document that provides an overview of the correction rule. Note that if the provider believes that its information is accurate it is not required to change it but in that case it must include in your medical records your statement disputing the information.

    I'm an expert critical thinker who has read thoroughly on the subject, from psychiatric textbooks to the DSM-4 and DSM-5. I've also read several books that carefully examine the scientific legitimacy (or lack thereof) of psychiatry, including...

    Mad Science: The Disorders of American Psychiatry - Psychiatric Coercion, Diagnosis, and Drugs;

    The Book of Woe: The DSM and the Unmaking of Psychiatry;

    Mad in America: Bad Science, Bad Medicine, and the Enduring Mistreatment of the Mentally Ill, among others.

    Were you to read them, you will learn that rigorous critical analyses of psychiatric research, methods, and treatment show that the entire field is astonishingly unscientific. Almost NO studies of psychiatric theories, techniques, and treatment produce adequate-quality results and almost NONE of those studies has ever been successfully replicated.

    The only psychiatric diagnoses that have any scientific legitimacy at all are those very few which produce biological "markers" that can be objectively analyzed. Essentially, everything else is unscientific personal opinion.

    I had no idea I was required to post an extensive medical and psychiatric history in order to ask a legal question!

    Of course I was seen, but the evaluation was NOT made by a actual psychiatrist, but instead by a non-psychiatrist, non-physician assistant. The crank psychiatrist failed to ask me any relevant questions and simply rubber-stamped the assistant. The crank has a very poor track record and very poor patient-grading marks.

    Furthermore, I most definitely do NOT meet even the minimum DSM-5 diagnosis criteria for ANY type of bipolar disease. These criteria do not require subtlety to evaluate: You either meet the minimum requirements or you don't. I don't.

    In the future, please show greater respect. I asked a legal question, not a medical or psychiatric one.

    Thankfully, reading a text book on brain surgery does not make you fit to perform brain surgery.

    It is not uncommon for assistants, in other words not the dr, to give tests and evaluations now days.
