    Default Is a Minor Father Liable to Pay Child Support

    My question involves child support in the State of: FL

    A 19 yr old girl is claiming that my 15 yr old son is the father of her child. She has said that when he turns 18, she is going to hit him up for support. By my calculations of the infants age, my son would have been only 13 yrs old when they had sex. What is the statute of limitations on her getting in trouble for this and can she sue him for child support if the infant is his.

    Yes, she can sue for support but your son needs to request a paternity test. Florida's laws re: stat rape are a bit goofy.

    As the father of the child he would still be liable for child support. As for whether she committed any crime here that would depend on the exact circumstances involved. If she was under age 18 and he was over age 12 at the time they has sex and your son consented to the sexual activity then my read of the Florida statutes is that she did not commit a sexual battery (which is the term Florida law uses rather than rape) offense here. You don’t have to figure that out, though. You may report what happened to the police and let the police and prosecutor sort out whether she may be prosecuted for any crime. Understand there is a trade off involved in doing this. If she is guilty of some offense, it may make you feel that justice is served by having her prosecuted. But if she is prosecuted and convicted then that may adversely impact her ability to care for the child, which could result in even greater burden on your son to care for the child. So I’d suggest discussing all this with a family law attorney now to get a handle on exactly what your son faces and what the options are before you do anything else.
