Default Re: How to Regain Custody of My Children from My Mother

Exactly! They own their own home, have 3 vehicles a camper and a motorcycle. Like I said it did take me a Lil while to get back on my feet and I'm still thankful that they helped them because I could've took them and bounced them around and that's not what I wanted for them. I try to stay on good terms because that's my mother and the kids love her. I also felt that I did owe that to her. But why did she wait over a year to get assistance for them? She does claim the kids on her income taxes because she gets retirement from the state of Ohio where she was a caseworker for the welfare. I made this thread wondering how I should go about getting them back where I live in Ohio and they are in Kentucky?

Again, you get nothing but respect from me for doing what needed to be done. You are free to go and pick up your kids - but if your Mom refuses, it's going to get messy and awkward and if she does file for custody she actually has a good shot. Your chances aren't zero though, and I think you need to do whatever it takes to get an attorney on board.

Because they live in Kentucky, that's where you'll have to file. You'll also be asking to relocate the kids out of state (I know it's only 15 minutes away but it might make a difference, because you'll have to switch schools unless they're somehow allowed to attend despite living out of state).

If nothing else, you need a court order giving you enforceable visitation. Can you remind us where Dad is in all of this? Because he'll need to be involved at least to some degree.

If they own all those resources your step dad doesn't get SSI. He probably gets SSDI or retirement, but definitely no SSI

There is something basic missing in all this...unless there is some relevant court order some place some how limiting your parental rights and or assigning legal custody to the grandparents the the grandparents may get a gold award for loving care but they have no legal standing and mom is free to go to the school and just pick up her own children? Going to GPs invites a confrontation...so why invite confrontations ....

What the GPs may have told IRS or anybody else is not the mothers issue ...

Yes the grandparents do have legal standing because MOTHER granted them that by contractually giving them her children. That "notarized" document is evidence of that. So basically you are incorrect.
