    Default How to Get Removed from a Sex Offender Registry

    My question involves criminal law for the state of: Michigan

    Hello, I was convicted of attempted rape in the 2nd degree in Oregon. Case was based off a internet sting operation run by various law enforcement agencies and the local news. I was convicted in Feb 2007, sentenced to 70 days in jail and did 3 years of probation. I completed all treatment programs, passed a polygraph, and underwent a risk assessment putting me at a Level 1 sex offender. The crime is a Class C Felony, and was told I could get off the sex offender registry after 10 years. Now, I have recently moved to Michigan, and upon registering here, I was classified as a Tier III sex offender, with lifetime registration, and required to report 4 times a year. Now, the question is do I have to go back to the convicting state to get off the registry or do I have to fight it here in Michigan?

    You'll have to abide by the requirements of the current state.

    But your conviction is not 10 years old yet anyway - I'm not entirely sure what you wish to accomplish at this time.

    You have to fight it in Michigan. If the Tier III classification is indeed correct, you won't be eligible for even a reduction for 25 years (unless you fall into one of the limited exclusions like the Romeo and Juilet laws, which I suspect do not apply here). Even at 25 years, it's not automatic. You have to go to court and there are additional restrictions.

    The thing I would check with a lawyer on in Michigan is if your offense has been properly classified as tier 3. It would seem to me that the equivalent Michigan offense would be 740.145a and that's only a Tier 2. Of course, a Tier 2 still has a 25 year registration requirement (and there is no way to shorten it).

    Thanks ron, I recall a very recent thread about the same thing, and the OP wasn't thrilled when he was told that he'd be living under the new state's rules.

    Ok I talked to a lawyer in Michigan. I was told that there isn't anything he could do, as Michigan wasn't the state that convicted me. But the charge that caused me to be a Tier III wasn't the same charge I was convicted with in Oregon. Rape 2, not attempted rape 2 is whats written. He also told me that if Oregon said I was eligible to get off the registry in 10 years, I would have to petition the court there. Kinda confusing a bit, but all I'm trying to do is straighten out the tier level here. I was told to contact the state police in Lansing, the lawyer stated that I should be a Tier I based on the circumstances of the crime. Kinda confusing, and would like to be pointed in the right direction. Lawyers here aren't helping me much.

    I'm truly not being snarky, but are you paying these attorneys? Most will be infinitely more helpful if you actually hire them ...
