    Default How Many Points Do You Get if You're Cited for Two Offenses from a Single Incident

    My question involves a traffic ticket from the state of: California.

    Quick facts: I was driving south on Highway 280 in the left-most lane. It may be worth noting that traffic is regularly in the 75-85mph area for large stretches of this highway (Basic Speed Law considerations). I see a police vehicle about 100-150 feet in front of me pull on to the highway from the right of the highway and turn on its sirens at about the same time, although I do not believe the sirens were actually sounding, just flashing. When the police vehicle is about 5-10 feet in front of me, and two lanes to my right, I see the officer inside point at me. In a state of mild panic, I immediately pull over to the left shoulder of the highway. I received two violations: VC 22349(a) speeding (88 in a 65) and VC 21806(a)(1) failure to yield. My total bail amount is $856. I have a payment option of traffic school, and that total is $618 + $49.

    1) First, I just want to confirm that even though I received two violations, it counts as just one point, and I can have it removed through traffic school (12810(j)).

    2) I would like some thoughts on the possibility of trying to have the fees reduced based on the facts above (specifically on the fact that a) the flow of traffic is always very fast on that highway and b) the circumstances surrounding why I pulled over to the left). If so, what is the appropriate way to request a fee reduction with the court? Is it worth the risk of the judge revoking the option of traffic school?

    3) I remember coming across a statute that says something along the lines of: if you get 2 violations in one ticket, and are traffic school eligible, you only have pay for the greater of the two violations, but I cannot find this statute. If it exists, is it already implemented in the slightly lower $618 + $49? If so, what it is the appropriate way to bring it to the court's attention to have my fee reduced?

    4) Is it worth trying to ask the court to reduce even the $618? (Including the $49 for traffic school, it's only less than $150 difference than the original $856).

    Any other info or advise would be greatly appreciated, because $856 is way to much for me. Thank you!

    You seem to be mistaken. Traffic school doesn't get you out of paying the fine. If you use the traffic school option, you will pay MORE. You pay the fine plus the traffic school fee plus the whatever the school wants for tuition. All it gets you is that the conviction isn't reported to the DMV which avoids the point and your insurance won't hear about it. You can only use it for one of the violations.

    Thanks for your response, and I apologize for the confusion. I understand that traffic school does not erase the fine. What I meant is to ask is does it clear me of all points on my record, because 12810(j) says: A conviction for only one violation arising from one occasion of arrest or citation shall be counted in determining the violation point count for the purposes of this section.
