    Default Delinquent Payor Was Given Additional Time to Pay Child Support

    My question involves child support in the State of: South Carolina

    I have a cs order and they ordered my kids father to pay 50$/ week. In June he was ordered to pay 842$ because he was behind. They gave him 30 days. Well he never paid and they issued a bench warrant. He gets locked up on the warrant. Here's the part I need the help understanding.. they let him out and he didn't have to pay a penny the judge gave him 30 days to pay money he was already ordered to pay and didn't!

    I thought with a bench warrant u either pay the money or do the time?? Is there anything I can do about this or someone I can talk to that could help me. You know the courts don't have a chain of command

    What do you think the odds are that he's going to be able to pay child support if he's incarcerated?

    What do you think is going to happen to his ability to pay child support if he loses his job?

    You need to balance your desire that he be punished against the purpose of the judge's actions -- which is to actually collect child support.

    We closed the debtors prisons long ago ...and in short inability to pay is a decent defense against not going to jail......refusal to pay can get one a trip to jail...but being in jail rarely helps one earn money to pay.

    Now if you have good reason to know he is working off the books or has other sources of income and you can get a get same before the judge..the judge might not be amused at his conduct....but I don't know how to implement any such steps.
