My question involves labor and employment law for the state of: New York
I have a T visa which is a visa for people who are victims of human trafficking. This is what is said about employment when possessing a T visa:
I got offered and accepted a job for Google and they have now pulled the offer saying that they can't hire me under this visa. I believe this is illegal. I have e-mails showing that the job was offered and then the offer was retracted because of my visa status. How can I proceed from here? What can I do to get my job back?Q. Can I Legally Work in the United States If I Have T Nonimmigrant Status?
A. Yes. When USCIS grants T nonimmigrant status, an Employment Authorization Document (EAD) is granted at the same time. The information for the EAD is generated from the Form I-914. There is no need to file a Form I-765, Application for Employment Authorization, along with the application for a T nonimmigrant status.
Thanks so much for your help!
