    Default Armed Robbery and Kidnap of Store Employees

    State of California.. at 22, my loved one committed a robbery against a pawn shop with 3 others n they had a gun. Owners were there so they ended up holding them. They got away with nothing and owners were not hurt. My loved one accepted a plea due to improper representation n fearful of getting 45 years. . Could not afford a lawyer at the time. He's been incarcerated for 12 years now, was given 17....but is trying to see if he could get a lawyer now get out instead of in 2017... he have robbery, kidnapping with enhanced gun charge where he got 10 years. He had no criminal history but got same sentence as the other guys who had extensive criminal background. . Is there anything that can be done to get out after an acceptance of plea? Can hee still fight to get out early?

    He's been incarcerated for 12 years???

    Sorry, the time to appeal has long since passed. You are certainly free to pay an attorney to review the matter and see if there are any options, but absent new evidence that shows him to be not guilty of the crime, he's not going anywhere until his term is up.
