My question is: What constitutes a legally binding agreement during divorce process??
To give background on this, my wife and i are going through a divorce. there really is not any property to divide up as we had always kept everything seperate. At the time that my wife asked for the divorce, i made one request; i asked for the engagement ring back. My reason for doing this is to recover money i spent for items in the house (at the time we seperated we had just renovated the kitchen, i paid a couple thousand dollars towards new appliances) I am using this as justification for asking for the ring back to recover money i spent on items i will never get to use. There are others items in the house that i paid money for as well that if she upholds her end of the agreement regarding the ring, i am happy leaving there for her use. she did not agree to return the ring and claimed it was a gift. My secondary proposal to this was that we take the ring, sell it and split the money for it. She agreed to this verbally, face to face. A couple days later i had text her asking if we could set an arrangement to take the ring to get sold. She wanted to wait longer, so i asked her to give me her word, and agree that we will take the ring, sell it and split the money. She replied back "i am okay with that, and i will agree to that.) Does that dialogue via text message constitute a legally binding agreement?
