    Default Landlord Wishes to Change Mind About Rental

    My question involves landlord-tenant law in the State of: California

    I have a room on my property, separate from the main house, that someone approached me about renting. I agreed to rent it, but I'm having second thoughts. She signed the rental agreement I drafted (but I have not signed it) and gave me a deposit. It's just under 30 days before she is scheduled to move in. What are my rights to cancel the agreement. Of course I would give her deposit back, and perhaps some extra for any inconvenience. I appreciate any assistance.

    None.

    You have a valid contract. You got her signature and her money. Your signature is not required to make it binding on you.

    You are free to offer to buy her out of the agreement but do it fast as the closer she gets to the move in date, the more monetary damages she is likely to incur.

    From now on, make damned sure you want to do something before you do it. Contracts can be very costly to back out of.

    How do you have a room separate from the main house? Is whatever it is even legal to rent as a residence?

    generally once you sign a contract you are bound by the contract.



    Is yhe the rental period month to month or is it a fixed term lease?

    Many a professionally crafted lease says it is not binding until both sides sign it...does your lease,say that?
