    It makes a huge difference

I have an investigator from the Sheriff's office...
    Not an attorney.

and they don't understand why the DA will not take the case.
    The D.A. is an attorney.

If you want to restrict the people who respond to your inquireis to lawyers licensed to practice in your state, I suggest picking up the phone and contacting some local law offices.

But again, even if a crime was committed, you have no RIGHT to demand prosecution. The injured party in a criminal action is society and it is the state that determines when that needs to result in prosecution not the putative victim.
Agreed. I don't think I have a RIGHT to demand prosecution. But I SHOULD have a right to be heard by the DA.

I have called every day for 3 weeks and no one will call me back. The only way I know the investigation was killed by the DA is when I called the Sheriff's investigator for an update he told me that the DA killed it because of the lack of a fence. He flat out said he didn't understand why the DA killed the investigation before he even talked to the logger. And he thought he had enough probable cause to subpoena the logging contract. He said he didn't understand why the DA killed the investigation and advised me to speak to the DA because it was out of his hands now.

If the DA would hear me out, and give a half decent explanation why this case should not be investigated I'd respect that. But they won't even give me that. I understand the office may be busy, but 3 weeks for a 5 minute phone call isn't asking too much.

So if the DA won't do anything, I'm seeking alternatives, that's why I'm here.... looking for the least worst option.

So if the DA told you exactly the same thing the posters here have you would be satisfied??
its obvious you do not care whether there was a crime as much as you insist somebody listen to your whining.

and your realistic options are to sue the bad people for your damages.

that was quite foolish. staff is almost certainly pressing delete as soon as they hear your voice now, and so none of your messages will be listened to

Thank you for the suggestion to talk to the Mayor, I spoke to him this morning and gave him a copy of all the evidence I have collected so far.

Long story short I just a call from the Sheriff's office and they have been given permission to continue the investigation, There were no promises about going to a grand jury, but I'm very thankful that the case is going to actually be investigated.

    Thanks again,
    AJ
