    Ok. My question was regarding possible criminal charges. I fully understand & understood the credit implications of the house however, I was being threatened with arrest by my ex wife that she's make up a domestic abuse charge and have me arrested. My career does not allow me to have taken that chance. My credit was already destroyed by the divorce I'm in the process of a bankruptcy already. The house is not my concern. The forgery is as with my job I can't have something like that out there. Plus if she defaults on the modification after the bankruptcy then I'm on the hook for it.

    As far as the family court is concerned she's been threatened with contempt several times she's denied me access to my daughter but she always promises to do the right thing and never does. Which takes more filing & more wasted money I don't have.

    If my ex is actually charged with this forgery I may finally have something solid to grant me full custody. Getting my daughter out of an awful situation is my main concern and if I have to use the criminal court legitimately in order to make the family court see the kind of people who are raising her then so be it.

    I get it about the house!

    My guess is that she won't be prosecuted for anything unless you report the forgery to the authorities.

    My guess is that the lender will do a cursory review of its paperwork and take the easy way out by enforcing the loan and foreclosing on the house.

    Their words to you are likely to be "Prove you didn't sign the papers."

    So far you lack evidence that she performed an illegal act..much less a conviction for same .

    And to leverage her unclean hands into loss of custody.....ultra unlikley ...unless there is a lot more too this and you have a super lawyer in NJ

    I just spoke with the fraud department. They were very helpful. They said it's clearly not my signature on the modification from my actual signature on the original mortgage. They are cancelling the modification.

    It is up to me to pursue criminal charges against my ex & father which I started the process of by filing a police report in Ft. Lauderdale. This is what the police in NJ told me to do. They informed Ft. Lauderdale PD will then forward the report to them & they'll take it from there. NJ Police are taking mortgage forgery & modification forgery VERY seriously.

    My bankruptcy attorney is now aware of this pending foreclosure and mortgage company will be working with him now.

    Then why didn't NJ take a report since that's where the forgers are?

    Oh well, follow up frequently to make sure that something is actually being done.

    They can't take a forgery complaint over the phone. It must be done in person for verification purposes.

    NO. I have the document in my possession. It's CLEARLY my fathers handwriting & my mother admitted to me it was him now. As I said before, the fraud department compared the signatures on the Modification to the original mortgage that I signed... they weren't even close.

    Getting the criminal waters all stirred up on forgery, which I doubt will really happen, is not going to solve any of your economic exposure or get your kids reassigned to you in FL

    Now if you have a good lawyer in NJ , you seem to hot headed to represent your self, sorry, ou might be able to get a buy out of her interest in the home at terms in your favor and get bank tomgomalong with you bailing out the situation at some discount..plus you just happen to get more favorable visitation order in place?.......OR....look, if Dad is bent on bailing out his daughter and you benefit from same, you want to bend over backwards to have him outbid you......

    Its OP's OWN father that is helping OP's ex wife. OP is also in bankruptcy himself so obviously he is not going to be trying to recover the house.
