    Default What Happens When a Divorcing Couple is Renting a Home from a Relative

    My question involves a marriage in the state of: Rhode Island

    Hello:

    My mother is seeking a divorce so I am doing some research. My grandfather (her dad) owns the house we live in. She is seeking a divorce, so would there be any difficulty with getting my father to leave the house since he does not own it; however, does pay rent? There are no documents or contracts about my parents renting it. Sorry if this is in the wrong spot! Thanks!

    He won't be able to stay for long, no matter what. Mom can file for divorce and ask for exclusive use of the marital home. Or, Grandpa could evict him per Rhode Island state laws.
