    Default Can a Landlord Evict You Over Damages Somebody Else Causes to the Premises

    My question involves landlord-tenant law in the State of: Ohio


    My house was broken into and they attempted to steal my car.
    They wrecked it into my landlords garage. I contacted the police and filed a report of the break in and attempted theft. I immediately called my insurance and reported everything to them as well.
    My insurance company completed an investigation and deemed me not at fault. They said that the garage is not covered because it was during a crime that the damage occurred even though I had coverage for property damage in my policy.

    I pay my rent on time if not a few days before the 1st of each month.

    Can he evict me because my insurance didn't pay?

    No.

    But if you are on month-to-month your tenancy can be terminated for any reason that's not prohibited by law as long as you are given proper notice.

    Study up on the Ohio landlord tenant statute.

    I agree with AdjusterJack but will also add that the landlord needs to be turning it in to his own insurance.

    A quick point on that.

    Your Property Damage Liability coverage pays if you are negligent in causing damage to the property of others.

    You were not negligent so your company doesn't have to pay.

    That's a good thing.

    Thank you so much! I have been losing sleep over this since it happened. Not only because someone invaded where I live, but worried about insurance and claims and eviction and just about everything there is to worry about!!.
    ADT installed security that I am gladly paying for each month to help me sleep at night and feel a sense of security...

    I feel a great weight was just lifted with your answers!!
