    Default How to Petition a Court for Post-Conviction Relief

    My question involves criminal law for the state of: Az
    I fully understand that normal procedure is for a LAWYER to fill out and submit a Post Conviction Relief form. I cannot afford ten grand, which is what I'm being quoted, to do this. PLEASE, I'm begging any of you that can help, to tell me if there is any way that I myself, can do this? There are only a couple days before the 90days are up.
    I realize that after this is filed, that I will need council for the inmate, and that funds will be needed. (Inmate has mental and neurological issues that make it impossible for them to even pretend to understand all of this ) I have groups that are working on that now, however, unless I can somehow manage to get this filed in just a couple days, I / the inmate, is doomed.
    If this isn't filed in the 90 day time period, is there anything that we can do?

    Question: In inmates personal belongings retrieved from the local jail, there are many forms stapled together. They are the "RIGHT TO APPEAL" forms.
    The form has an area that states : "Copy of This Notice Received" and an area to be dated, and signed by the Defendant. Shouldn't this have been signed to show that the defendant received it?

    The signed copy is likely on file with the court. It's also possible that receipt was acknowledged on the record, if the papers were delivered in court.

    If you are not the inmate and are not his lawyer, you cannot represent him in court and likely cannot file or draft court documents for him, either. In any event, there isn’t much anyone here can do to tell you what the inmate must do to file for the relief. We know nothing of his case or on what basis, if any, he might have a claim for post-conviction relief. The details matter. There isn’t simply some standard boilerplate language that you put on every action for post conviction relief that will work.
