My question involves landlord-tenant law in the State of: California.
Hi,
I live in California, and I'm currently a senior at University. My sophomore year (3 years ago because I'm technically a super senior now) I moved in with two other roommates. We didn't work out, one left early, so two of us paid the rent and then I left early due to issues that the roommates had caused and basically going into a slight phase of depression because of the living situation. I waited until 30 days before the lease to give my notice like they ask for regardless, so I thought this would notify them that I didn't want to renew my lease. That should be that, right? Lease is over and ending and it's all peachy and fine.
I received an email yesterday stating that I had been remitted for my old apartment with the two old leaseholders. What? Apparently because one roommate didn't leave all 3 original lease holders are stuck on this lease again. I emailed the apartment complex to tell them I didn't consent to this, and that I'm not even living in the same city anymore. I actually commute 50+ to and from twice a week to get to school now because it ended up being cheaper than living in the city my university is located in. Also i'm not financially stable, mentally or emotionally stable right now to sign a lease and live with these particular roommates. Thinking about them again is actually giving me an anxiety attack.
When I asked the apartment complex for help regarding this situation they notified me that I was stuck on this lease because one original lease holder wanted it again, even after all this time. So no one comes off and no one is added.
What can I or should I do? This means if for some reason I wanted to rent a new place within the apartment complex I wouldn't be allowed to because my old roommate. They won't even let me know which roommate is behind this. 3 years later of thinking I have been rid of these obligations I find out I'm still stuck on a lease for a place in a city I no longer live in?
Can someone please help me. Am I going to have wait just not pay in hopes my old roommate gets evicted?
