    Default Commercial Tenant's Responsibility for Common Area Maintenance (CAM) Charges

    My question involves landlord-tenant law in the State of: Utah, I previously posted about the landlord blocking my sale. My question now is about the 25% I agreed to pay in all utilities. Can he take that 25% percent across the board for his cam charges as well. It states in my lease in one paragraph that I will owe my pro-rated share of cam charges. Another paragraph is the part that I agreed to pay 25% of all the utilities. The building is 5100 sq. feet my rental portion is 500 sq. feet. I am one tenth of his property. I am the one who has added gardens kept up the property in cleanliness and tried to keep it presentable as he does nothing of the sort. I have pictures of this as well. The other tenants are grateful. He has just left a note saying if I don't pay he will send it to collections. I have not paid these extra cam charges as I don't feel this is my responsibility. I'm contacting an attorney but this will take some time. Do I have a leg to stand on ? Thank you for listening....

    CAM charges are not utility charges. The clause relating to utility costs does not apply to charges that have nothing to do with utilities.

    The clause in which you agreed to pay a prorated share of CAM charges is the clause under which you contractually obligated yourself to pay your prorated share of CAM charges. You contractually obligated yourself to pay CAM charges if they were incurred by your landlord and properly billed to you.

    You should read your lease to see what it says about how the CAM charges are to be prorated -- whether it's by your square footage, by the number of tenants in occupancy, or by some other means. If CAM charges have been assessed in the past, and your lease is silent on how they are to be prorated, that past practice may govern.
