    Exclamation What Happens to Your Lease if the House You're Renting is Sold

    My question involves landlord-tenant law in the State of: Tennessee

    My landlord's realtor has informed me that the house has been sold and the sale will close "at the end of august". He is trying to find me a home and get me out of the house as soon as possible.

    I have received no written notices of any kind from him or my landlord. I cannot find any clause in my lease regarding this instance.

    In addition, I am having great difficulty finding any laws regarding this matter.

    If the lease has no clause addressing this, it remains in effect when the property is sold. The only thing that breaks a lease is foreclosure.

    If you are still under a lease, (not month to month) the new owner would have to honor your lease. I suspect that if you are still under a lease, that a condition of the sale is that you vacate the property prior to or at closing. That is the only reason I can think of why the seller's realtor would be motivated to find you somewhere else to live.

    If you are still under a lease I suggest that you do a google search for "cash for keys" for your state.

    It would be in your best interest to make certain that anything that they agreed to pay you, including your security deposit, is paid to you before you actually, legally, vacate the home. IE that they turn the money over to you in exchange for the keys...perhaps after a joint walk through of the home.

    You're going to need to tell us what the expiration date of your lease is.

    It is NOT your job to remind LL how to do things....and absent proper notice, the time clock has not even begun to tick as to eviction...
