    Default Surreptitiously Filming Women's Legs on a Train

    My concern is more about can Sacramento PD search my cellphone they seized?

    I do have video on the phone but I don't want them to search it. The officer did mention that they can't search it right there because of a recent law passing. But they can obtain a warrant. Can they search the phone?

    With a warrant, yes.

    Stop filming women on trains unless you have their absolute permission to record.

    Default Filming of Women's Legs on Train

    A security guard caught me filming a woman's legs on the train and reported me to the Sacramento PD. PD was waiting for me at the next stop. They seized my phone. They were very polite and so was I. I worried that they will get a warrant to search my phone.

    Not sure what I should do.... I'm seeking legal help to prevent warrant? I don't know.

    Stop filming women without their permission. Yes the police can get a warrant...and probably will.

    How would they obtain one? It was a security guard who reported me. The officers were very nice and I was very nice too.

    Needless to say, this has prompted me to stop of course.

    Is there some law against videotaping on the public-transportation system? If not, and if the women's legs can be seen by the public, then why would it be against the law to videotape women's legs?

    They prepare an affidavit and take it to the judge or magistrate and have it issued.

    Just because the cops were polite and friendly doesn't mean they're not going to have you charged. Of course, barring filming in places that clothing would normally cover there is no charge along those lines. Of course, you could be charged with some sort of disorderly conduct.

    Sit tight and hope they decide not to pursue this. If you hear anything from the police or the prosecutor, do not respond to them without speaking to an attorney. Despite their jolly nature, they are NOT your friends.

    It was legs and not upskirt.
