    Default Can Police Conduct a Parole Search when the Parolee is Not Home

    My question involves criminal law for the state of: California , Today the local police department came to my house while i was not there and parents opened door and they proceeded to search my room, there was no specific reason it was "random" but they found a bottle of fake urine i didnt know i even had plus a few nude pics of my gf inside a card in a sealed envelope also i didnt realize i had. They say they are notifying parole officer. Are they allowed tondo this without me being present?

    You didn't know you had a bottle of fake urine? That is gonna fly about as well as a lead balloon. Expect many random drug tests in your future with someone standing there watching you.

    I can see not knowing about the pics if the card was sealed, and would question why they opened a sealed envelope. I don't see where those would be a violation unless you're on parole for a sex offense or she is a minor but we don't know the full terms of your probation.

    You need to call your PO first thing today and speak to them about it.

    And to answer your question, the answer is obviously YES. Your parole conditions allow them to search your person or your home (and no you don't have to be present) at any time (they do not need a reason). Besides, it would appear that the search was consensual on the property owner, so you'd have a hard time suppressing this evidence even if it didn't involve parole.

    You need to talk to your PO and be more truthful with him than you are being with us. I don't believe word one of your story.

    Yes, they are. You don't get to hide from a parole search by not being home or not answering the door.
