    How does a tenant still living there expect a security deposit back just yet?

    I agree with others that your various RM s may have a legitimate beef If they are taxed to cover your damages ....but I disagree that it is an issue under LT or security deposit law .

    The aggrieved RM is free to sue..and she has the burden of proof as to her point of view and relevant law

    I didn't trashed my room whatsoever, the room was empty when I move out I swept the floor and I didn't leave anything in there. He said he replaced one 4 by 4 area of the floor that had dog urine on it and one small area of the floor. My floor was hardwood. He didn't replaced the entire floor just two parts that i described in the sentence before. I have asked for copies of the receipts/checks he did for the repairs but he hasn't been responding. I sent the email on Monday. He only gave us a typed up invoice of the cost but no actual copies of receipts or checks. Here's what he wrote for the invoice

    damages to front bedroom upstairs

    Bill receipts

    EMC #8248 $ 97.40

    caravatis #8254 $ 231.86

    chas watters #8255 repair floor $ 600.00

    chas watters #8259 repair floor $ 600.00

    siewers MC-6-9-2015 wood $ 21.99

    va paint MC-6-5-2015 paint $ 63.57

    Susan receipts

    lowes LCC-6-10-2015 paint $ 16.95

    lowes LCC-6-9-2015 poly $ 18.34

    va paint visa 6-2-2015 paint $ 146.34

    Labor

    painting 14 hours @ $25 $ 350.00

    clean 12 hrs @ $25 $ 300.00

    total $2,446.45

    HAUL debris left on sidewalk

    from front room upstairs $ 50.00

    from north-rear bedroom upstairs $ 25.00

    total $2,521.45

    LESS security deposit $1,800.00

    due to the owner $ 721.45

    She wants me to pay her portion of the security deposit that she is putting down because they LL is asking for a new deposit.

    We have been told that the OP's lease has ended, and that the landlord is negotiating a new lease with one (or more) of the former roommates, for which a security deposit is required.

    The OP raises it as a question under VA LT law...I,don't think that's where it belongs.
    But there could be two issues ...
    The new lease new deposit is a different new matter.

    One or two tenants have a beef with a third over damages claimed and deducted by Ll
    To the extent that one or two of them claim OP caused a big pile of damages ..they may well have a point..if they can prove it..and that's probably a small claims action. And that's the core of OPs question.

    There is a side point that OP says hey my room was Ok yet we got whopping repair bill. Now if LLs Bill is excessive or,covers stuff ordinarily treated as wear and tear (unless lease says otherwise)'then all three of them may need to consider counter claim against LL.

    The OP has a difficult time taking responsibility, but has effectively admitted that she caused all of the damage that the landlord has billed for. Her complaint seems to be that she only damaged two areas of the floor, including a 4'x4' area of hardwood where she allowed her dog to urinate on the floor. You are not going to convince a court that having to pull up and replace a portion of a hardwood floor due to pet urine is "ordinary wear and tear". Hardwood floor repair is labor-intensive, and a floor repair of that type will require refinishing the floor in the room, as otherwise the patched areas will be obvious.

    I am going to pay the landlord the additional $700 my mom said that we will pay the landlord back. My mom doesn't want to pay the roommates their portion of the deposit because she said that they would have to talk with the landlord about it.

    Some of the respondents here are seasoned LLs and I suspect one respondent is a darn smart lawyer

    Unless your mother is a lawyer or a well seasoned Ll, I would suggest you get a more reliable resource...your RMs seem to have a very good equitable point against you that you created a major cost problem...and backing out your costs, there would,be a tidy return to them of security deposit ,share....

    so how do i deal with the roommate that is currently still living there and needs a new deposit? also the other roommate isn't on the lease and didn't sign a lease, she was listed as roommate. her name isn't on there. My landlord said that his ad say no pets but in the lease we signed said nothing about pets. My roommates knew I had a dog and the landlord even saw my dog. also what do you mean by equitable point? we didn't have a roommate agreement on who will be responsible for damages if they did it themselves. also we were on a month to month lease since our landlord never gave us a new lease to sign

    It's not between them and the landlord -- it's between them and you. If you effectively took money out of their pockets by causing the damage, they can ask you to reimburse them and, if you don't, they can sue you in small claims court.

    Possibilities that come to mind: You (a) pay her the money, (b) try to get her to agree to accept a lesser amount, (c) refuse to pay anything and see what she does....

    Unless they told you to let your dog pee on the floor, and to be so neglectful about cleaning up the urine that you damaged a large area of hardwood flooring, the fact that they knew you had a dog is irrelevant.
