    Default Adding a Screen Wall to a Neighbors Garden Wall

    My question involves real estate located in the State of: California
    I have a swimming pool. When the pool was installed, a six foot tall block was put up. My neighbor had a two foot wooden screen attached to the top of my wall. She had a recent survey performed and the wall is clearly on my property although she denies it.
    How can I get the screen remove other than cutting it down myself.

    just for accuracy sake, define: clearly on your property


    just wanting to make sure it is not a shared boundary or division wall.

    but if it is not a shared wall:

    send a demand letter to the neighbor demanding the screen be removed

    you may consider having an attorney drafting and sending said letter

    if neither is successful and you don't want to remove it yourself, suing her would be the next step seeking either a courts order requiring her to remove it or allowing you to remove it.

    but the question I have is; why didn't you say something about the attachment at the time?

    I can remove the wooden screen. The police came out and spoke to both parties. If I cut it, they will take a report. It would be the simple solution.

    She had it installed when we were gone for the day and the gate is not locked.

    Your choices are:

    If the fence/wall is clearly on your property then you have the right to do whatever you want. That may mean some temporary "hassle".

    You also have the right to just live with it.

    Ok, so what are you after? \

    If you do not want to remove it yourself, you either ask (make a demand) she remove it or head to court where a court may require her to remove it but may also give you permission to remove it and possibly recoup your costs in doing that.
