1. Can/should I still file a complaint with the DOL for OT?
2. Sine I'm still there I suppose if at the end they say "hey let's stay together" I'm no longer fired and elegible for ui

If you want the money.
Probably, but if you do #1, I'm sure it won't last long. You could probably even say before going to DOL, "hey, I want you to pay me for my overtime, and if you don't, I'm going to the DOL and you can deal with them," and I'm sure they'll fire you again. It's the whole point of going to your employer to fix things, if you do it right, you don't have to quit. They just send you packing and turn a quit into a discharge.
