    Default Asbestos Ceiling Collapse in a Rented Home

    My question involves landlord-tenant law in the State of: California

    Two weeks after renting a condo the acoustic ceiling containing asbestos collapsed in our living room after a rain storm. The internal gutters had been repaired just prior to our move in. initially we were told the HOA would cover displacement costs which makes sense as they roof is their responsibility, then they told us the contractor who did the work would take care of us. The Contractor is now saying that the work he performed was compromised by problems in the roof that the HOA was aware of. We are now at day 7 and have rapidly mounting costs.

    The landlords homeowners insurance will take care of asbestos abatement but not for our belongings, we are concerned with what will happen to our them. We are at a complete loss for who to call - the Housing Dept. will not help us because we are in a condo, is there a City dept. that can help us. Should we go to he City code enforcement? We do not have renters insurance.

    Too bad.

    You get to cover your own losses as long as nobody was negligent in causing the ceiling to collapse.

    Thanks for your reply. Would fact that the roof had been repaired just weeks before and that there were prior leaks would suggest that either the roof was not repaired properly or that there is an underlying problem with the roof?
    What would be the best way to prove negligence - should we get building inspectors out?

    If you want to try to prove that somebody was negligent, you will need evidence of negligence. You can see if you can hire an expert contractor to inspect the ceiling for any relevant evidence as to the cause of the collapse, if that's still possible at this point in the remediation.
