My question involves criminal law for the state of: Florida
My husband and I just moved a month back from NY to FL, we had to stay at his parents as we tried to find our own place, one crazy night he took his sleep med, anxiety med, had a beer and was ready for bed, he decide to tell me a good news before heading to bed and for some reason I decided it was time to talk about issues that bothered me regarding the "good news" the little issue became a big fight and turned into me yelling and him ignoring me, he couldn't stay up any longer and wanted to go to sleep but I was still upset so I told him I'll be taking some money from our Joint account to find myself a place to sleep in cause I didn't want to stay at his parents anymore, he said we didn't have the extra money for that right now but Ignore him and went to the bedroom to get our bank card, as I was heading out he told me to stop, trying to convince me we cant afford to do that right now but... sadly I carried on cause I was angry fully knowing we couldn't afford it, so he grabbed my purse to take it from me, I held on tightly and wouldn't let go, so he started hitting on my hand continuously until I finally let go, he took our bank card and went to sleep on the couch.
I looked at my nail and realized it hard been bent backward pretty bad so I told him I was gonna call the cops on him, he said nothing so I did....
He was arrested and charged with domestic battery, I honestly had no clue what I was doing when I called, I'm 21 and have never had to deal with the legal system, we had properties in NY and when a tenant gets in a fight with my husband he calls the cop to scare them but tells the cop if he wants to or not have them arrested, this was my only view of calling the cops. I had no clue the difference btw domestic violence and so on, I thought I could call the cops and they would give him a warning or something.
I know he intentionally hit me but I cant help but regret not just going to sleep and talking the next morning instead letting my emotions control me... He spent the night in jail and was given a restraining order, he cant come back to his parents house or contact me. I spoke to the State attorney yesterday and I basically told her what I said above, she said of course I cant drop charges but she gave me a "Request to waive prosecution paper" to sign and I did, as stated above we just moved and are completely broke, we have no money for a lawyer and from what I heard his parents say, the Public Defender has been refusing to speak with him .... his arraignment date is in a week.
My questions : what are the possibilities the State Attorney will drop charges? I don't want to keep him away from his family, what can he do or file so he can return to his parents home? (I of course can find somewhere else) How long after the arraignment is the pre trial? and after that what next? Our lawyer friend told him to plead not guilty, what are the possible outcome of doing this and how long till all this ends
