    Angry Landlord Gave Only Two Weeks Notice to Terminate a Tenancy

    My question involves landlord-tenant law in the State of: California

    I'm a subtenant who is renting a room from the master tenant in a 2-bedroom unit.
    The master tenant recently asked me to move out within two weeks for having my room messy. My room certainly isn't the cleanest room in the world but I don't think it's that messy. I never ate food or drank anything other than water in my room, so there really isn't much of serious mess here. I have some papers, package boxes, and an empty water bottle in my room and other than vacuuming, that's about everything that needs to be cleaned up.

    Now, the thing is that I always keep my door closed and never gave her a permission to enter my room. The fact that she knows the current condition of my room suggests that she may have entered my room without notifying me while I wasn't home because it's impossible see inside the room unless you enter the room or look directly at it through the window. In fact, I was away for few days (I told her that I'll be out of town before leaving) and when I came back, I noticed that the position of my window has changed, which pretty much means that she has entered my room while I was away.

    I always paid my rent on time and always cleaned after myself after using common areas, such as bathroom and kitchen. I also washed my dishes right after eating, didn't do much of cooking in the first place, and haven't caused any trouble. In fact, I don't even smoke or drink. When the master tenant's boyfriend stayed in the unit for several weeks without notifying me or asking for my permission, I didn't say anything about it because I didn't want to go through any argument. Now that she did this to me, I even somewhat feel betrayed.

    Can the master tenant do this to me? And how should I react?

    Read the CA L-T law....last I looked oral notice was not sufficient notice

    This is one time/place NOT to educate or comment to your LL....until they get the steps right..they lack legal leverage.

    Ultimately your LL will get the steps right...but not that quickly....in the meantime you need to be considering new place.........

    Then go back to the guide and see Page 50 where it explains landlord's notice to end periodic tenancy.

    Now go find yourself a studio or efficiency unit that you can afford on your own and move.

    Keep renting rooms from people or get into other roommate situations and the same kind of stuff is going to keep happening.

    Thanks for the quick replies.
    Just to give you some more background information, she notified me through email last Saturday while I was out of town. It didn't include a formal document but just asked me to move out in the email.

    I'm actually in this town temporarily during the summer and planning on moving out in mid-August to go back to my own home in another state, which she agreed at the beginning of the lease. If I have to move out at the end of this month, I'll have to find another place to stay for two weeks, which will require me to go through quite a bit of effort and time. Looking at the tenants' rights, it looks like I'm supposed to get a 30-day notice, not 2-weeks. Can I use this fact to tell her that I have a right to stay for at least another 30 days? Since I'm planning on moving out in mid-August anyway, 30 days is all I need to avoid going through finding a new place to live.

    Personally I would NOT educate my LL any earlier than MY need to do,so..just in case it's notmquite as easy to move out.....but pay attention to your duty to notify her lest you get stuck with a bit of rent at the tail end .

    YouNhave a right to stay as long as you like until she gets notice right...and she has not got it right!
