    Default When Does CPS Drug Test Parents of Children in Protective Proceedings

    My question involves a child custody case from the State of: Missouri

    My daughter was taken by CPS/DFS from her mother due to her other child's father calling them and stating that she was taking drugs. (in February, without making me aware)

    She was passed around her family members until n one else wanted to care for her. No one told me anything! The mother lies to me all the time.

    I pay child support always and on time. I don't visit as often as I should due to the distance between us. My daughter knows me as Daddy.

    Turned out that the drug test was positive for Meth and they took her.

    The mother wants me to attend a meeting with DFS/CPS that I have 3 days notice of tomorrow morning. My daughter's mother informed me that they would drug test me and I have marijuana in my system. I do no other drugs nor drank any alcohol.

    I have other children too that live with me. If I go and I am honest or fail that drug test will they take my other children and investigate me?

    I am getting a lawyer tomorrow in the morning but I am unsure if I he will have the time to attend the meeting. I wish she had given me more time but she doesn't want me to have her... she just has no other choice.

    I cannot have my other children taken but I cannot just not go to the meeting either? If I don't go to the meeting then I am afraid that she will go to a foster home and it will be harder for me to get her for one and for two it will show CPS/DFS I don't care. Though they haven't informed me of anything!

    Any advice would be great. The meeting is in 9 and a half hours.

    I'd like to say that weed is a non-issue, but I can't - and I'm not even sure whether you'd be tested on the spot, either. How old is your daughter?

    She is 7 years old.

    I am unsure what to do if I cannot get a lawyer in time or something. I don't want to risk losing my other two children at all but I must do something.

    Get thee before an attorney first thing in the morning, be completely honest with him and ask he if feels it would be prudent to postpone the hearing tomorrow.

    Yes, I am the father. Equal rights and all that hasn't passed onto us yet... if I postpone it she may be headed to a foster home. Would that make it more difficult?

    It's nothing to do with equal rights.

    It has everything to do with what's in the best interest of the child.

    So who is she living with now? How often have you visited her during the last say.... 2-3 years?

    Oh, Holy Hannah. THIS whiner. Who takes absolutely no responsibility for his actions.

    OP, you can't afford not to be represented at that meeting. If you're not sure your lawyer can be there, either get another lawyer or be there yourself.

    No excuse is good enough. That's if you really care about the child. If you don't, well, I guess we'll know that by what happens at the meeting, won't we?

    You have equal rights before the court. Your rights do not include smacking your wife with a cigarette because she wasn't giving you "respect." Or hitting the gas while she's trying to exit the vehicle.
