    Default Unable to Transfer Title Even Though the Lien Was Paid Off

    My question involves vehicle registration or title in the state of: New York / Florida

    Hey guys, so I live in Florida, and recently bought a motorcycle. This motorcycle has a New York State Lien Title. I knew that going into this.

    The lien was paid off, and all the proper OFFICIAL paperwork stating that the lien was paid was supplied to me, with signatures from CEO's of Capital One and HSBC, etc.

    I brought it to the DMV today, and they refused to transfer ownership of the title to me. The letter that was given to me as proof of the lien being paid off was sent by Capitol One, it included the VIN, last four digits of the previous owner's account number, etc. As of 1/22/2015, the lien is satisfied.

    They claim this is not sufficient, because on the title, the Lienholder is HSBC Bank. Of course, I bought this bike from someone who is in the military. He's not responding to texts, and his phone goes straight to voicemail. I'm about to get the police involved and show up at his door.

    Am I screwed? Is there anything I can do to get this registered without getting the legal system involved? Thanks.

    I presume you mean you brought it to the FLORIDA DMV. Yeah, they can't do anything for you. You need to contact the NY DMV and get the lien released there. You could try calling HSBC and seeing if they can retransmit the lien release to NY, but they might refuse to speak to you as you are nobody to them.

    If you can't get this resolved with either DMV you may be able to get a bonded title.

    Here are the forms:

    If it comes to that, print them out, go back to the Florida DMV and say "I want to do this."

    You'll be given instructions if that method is available to you.

    I contacted HSBC, and they put a request in, which I'll have the answer to in 7-10 business days. I also contacted Capital One, who told me that HSBC was bought out by Capital One, which explains why the letter sent was by Capital One and not HSBC, but their finance branch is not open on weekends, so they can't help me until Monday.

    So you're saying I need to call the NY DMV, and pay to get a new title? Then transfer it to a Florida Title?

    At the minimum, NY has to revise their records to indicate the lien is released. After that, it would depend on:

    1. Whether Florida will verify that electronically, or
    2. Whether you will need to obtain a duplicate paper title without the lien, and then
    3. If Florida will accept the assignment of ownership on the title you do have signed with a copy of the "clean" title as proof there is no lien.

    Maybe.

    But I suggest waiting until you've exhausted any possibility that Capital One can provide a proper lien release that's acceptable to Florida.
