    Default Why Would a Criminal Record Online Search Fail to Produce a Record

    My question involves criminal records for the state of: New Jersey/New York

    under what circumstances would a person's record not be available in online search of nationwide corrections databases and individual states databases. Could this be mean that records were sealed/pardoned/expunged? How does one find out if this is the case?

    While its possible that a record could be sealed/pardoned/expunged, the more likely reason that someone does not show in any criminal database is because they have no criminal record.

    It's not likely that records were sealed/pardoned/expunged without the person in question being aware of it. So while ll is exactly right, if one presumes that the person in question actually does have a record, you might also look to servers being down, manual records not yet being digitally updated, or the person requesting the records asking the wrong questions.

    Are you the person doing the search or the person being searched?

    Also depends what databases you're talking about. A lot of the commercial background check companies are fraught with peril (and some won't go back more than seven years). This doesn't mean that the criminal record doesn't exist for those willing to go to the individual state records.
