    Default Can a Union Force an Internal Hire

    My question involves labor and employment law for the state of: Washington.

    Hello everybody,

    My dear friend, Jane, has been working as an intern through school with Head Start for the past school year. As she graduated this spring, she applied for 1 of 2 openings as an FSC. Most the entire office, including her boss who is on the hiring committee, wanted Jane for the job. She was 1st or 2nd on their hiring ranking. As the title indicates, the union stepped in and forced internal hires instead, excluding Jane. She did not get the job.

    Clearly this is an unfortunate part of life. However, I am asking you whether this is legal.

    If it was not legal, the union would not have been able to force the issue.

    I'm sure the internal hires would have thought it was quite unfair if someone from the outside (i.e. Jane) was hired instead of them. Fair is in the eye of the beholder.
