    Default Do You Have to Submit Bail When Filing for a Trial by Written Declaration

    My question involves a traffic ticket from the state of: California

    The ticket says 95 in a 65. I am doing a trial by written decleration. It was paced, no radar or lidar.
    1. My question is with the new law, do I still have to pay bail to submit trial by written decleration or
    can I wait to be found guilty?

    2. Also, I want to leave a note that if it is not thrown out it should be reduced to a non-moving violation.
    First ticket on record, I have been driving for seven years. Would this be recommended?

    3. Does the bail have to be paid in cash or can it be card?

    1. What new law? You must submit bail with your TBD request.

    2. You can add such a note, but it will be disregarded. There are really only two buttons as far as the judge is concerned: GUILTY BAIL FORFEITED and NOT GUILTY BAIL REFUNDED.

    3. Most California courts will accept credit cards with a surcharge.

    Courts have some time to comply with the new law. You will get a courtesy notice that will instruct you if you have to post bail with TBD. Follow the instructions in it.

    You can avoid posting bail even now if you come to arraignment and plead not guilty. TBD is anyway a waste of time... you will lose that.

    Perhaps you should rephrase ... You MAY get a courtesy notice that will provide these instructions and other information. A courtesy notice is neither a right nor a guarantee, so, if you want to be sure, contact the court and ask them directly.
