    Default Entering a Polygamous Marriage

    My question involves marriage law for the State of: Illinois (Cook County/Chicago)

    Two of my friends want to get a polyandrous marriage license on Monday (6/27/2015) (MMF).

    With the ruling today on Obergefell v. Hodges (same sex marriage), it appears Justice Roberts notes the same premises for same sex marriages also would appear to plural marriages:

    Illinois only appears to have a law for bigamy that requires someone already be married; none of us are married nor performing marriage "sequentially" but rather "at the same time". Therefore, nobody would meet bigamy. More wiki on "Bigamy":

    For federal law, all i'm really seeing is the Morril Anti-Bigamy Act:

    I don't see what law we'd be violating (state or federal) by trying to obtain, and process the marriage license; all laws are on "Bigamy" and not polygamy, polygyny, or polyandry.

    If we really want to test the waters of how today's ruling could impact plural marriage, what should we do or say at the county clerk? We have the marriage party, a photographer, and a minister ready.

    Is anyone interested in helping us pull this off or help write the 3 person prenup? What would we get rejected on or possibly charged with?

    The decision does NOTHING for plural marriages. NOTHING AT ALL. You would be committing a felony based upon the order in which the marriage licenses are filed. The decision -- all 103 pages including dissent -- states time and again that it is marriage between two people. NOT more.

    Despite the bleating of some same sex marriage opponents that as a result of the opinion released yesterday the sky is falling and the opinion will now lead to court decisions saying that states cannot bar marriages involving more than two people, nothing in the opinion says that nor is there really any rational basis to suppose that will occur. The reality is that no state today allows such marriages and I think its fair to say that the courts aren’t going to take that leap any time soon. Yesterday’s decision was about permitting two people of the same sex the right to do what the law in every state allows two people of the opposite sex to do: get married.

    I'm pretty sure Chief Justice Roberts dissent rationally disagreed with your statement however, thanks for the thoughts.

    If they enter in a record one by one, that's their system which i don't care. That didn't make me a bigamist. The claim would i married two people at the SAME EXACT time in one execution. If you're not committing bigamy, then you're not committing a felony; exactly as worded.

    Ironically your right though, the ruling does nothing for it other than have the Chief Justice say stuff about how this kinda opens the door, but since "it's not being petitioned" he won't comment on that.

    So... **** it, lets petition it.

    A dissent has NO precedent for anything. It can be used to prove your misguided point. And yes, you would be executing sequentially. Because that is how it is filed. And that is what matters. The ceremony matters not. How the licenses are filed matters. Your ignorance is noted.

    Default How to Generate a "Bystander Report" - Starting Path to Contests Polygamy

    My question involves civil rights in the State of: ILLINOIS

    I want to challenge the ability to have a plural marriage in Illinois (Polygamy, NOT Bigamy). Bigamy is sequential (serial) marriage, and not "parallel".

    I'm told the way i need to start is to actually go to the vital records office and attempt to get a marriage license with all 3+ names on it, then create "Bystander Report" saying basically what happened then... start legal filings.. words like request for relief, appeals, and so on.

    Can someone kind of walk me through the process (hey, even a link is fine). I saw a few sources on how to file appeals pro-se but... perhaps someone has good advice to get me started and i can spoon feed to where i need to go. I can't afford a $25,000+ retainer. I know this would be something that would require appeal court filings, possibly Illinois Supreme court filings, and perhaps even ultimately U.S. Supreme Court.

    For now, i'm most concerned about said Bystander report.

    A sample of one online for format and content would be awesome.

    I don’t know where you heard about this “bystander report.” If it wasn’t an attorney telling you that, then it is likely wrong. I know of no state that requires or utilizes such a thing. If you really want to try this, consult an attorney ahead of time. But I can guarantee you the legal challenge you propose on this will fail. It will be not worth your time or money.
