    Exclamation Can You Fight a Speeding Ticket Based on Minor Errors

    Washington State speeding ticket. I've been researching how to contest my ticket for a week now. I have multiple questions. First discrepancies on my ticket. I've heard that most minor ones will not get the case dismissed.

    Ticket and Drivers Licence will be included below.

    1. The cop wrote down a mile marker that is around 5-7 miles away from the place he pulled me over. Which I have no proof of except for the fact I told him that I had just been using my cruise control before the last town. Which is where his mile marker claims he pulled me over.
    2. Besides that, my weight is 15 pounds off... Even though he should have been copying it from my ID.
    3. And he also said I was clocked at 66 miles per hour in a 55, and he put me in the 10 over bracket.


    Other things I am worried about are the fact I didn't have insurance at the time of the incident, and he didn't write me down for it because I told him I had accidentally thrown it out when I cleaned my car out two weeks before. On the ticket it says nothing of this. Can this be brought up in court, and they request I show my proof of insurance, then charge me with that offense too if I fail to?

    Please tell me in what way your weight affects whether you were or were not speeding.

    The location of the traffic violation is rarely going to be the same as the point at which somebody is pulled over.

    Irrelevant to your speed.

    You are free to argue to the court that you were speeding in excess of 10 MPH and should be convicted of the more serious offense, but being given a break is not a defense to your ticket.

    Thank you for your input. I was a tow truck driver and got into a bunch of trouble if I didn't fill out the paper work to the T. I was just wondering if there was similarities for police officers. (I honestly find it Amazingly stupid they hold us more accountable then themselves.) And what about my last question? Will they ask for my insurance? Does the prosecutor have anyway of charging me with no insurance?

    The crystal ball is out being recalibrated, the Magic 8 ball is broken and Madame Zuleika has not returned from her vacation. So we cannot look into the future and tell you what WILL happen. Obviously if you were driving without insurance you CAN be charged with it. Whether you WILL be charged with it is unknown.

    You are going about this the wrong way. The best place to look for errors is on the officer’s sworn statement and on the certificate for the SMD he used. Be sure to read the sticky thread Procedural Guide to Traffic Tickets in Washington State which links to a discovery template with instructions.

    Also when you receive discovery materials you can check to see if he mentioned anything about your insurance.
