    Default Liability for a Downstair's Neighbor's Ceiling Repair Due to a Leaky Toilet

    He cut his ceiling because of mold caused by long time leaks from my toilet flange. He asked me to pay his ceiling but I disputed as I believe have no negligence. I asked him to put his ceiling back but he said I need to pay it first. He also asked for the loss of rent. Why can't he put his ceiling back then figure out the responsibility of issues? It's been almost a month since I fixed my leaks. What should I do now?

    Some possibilities that come to mind: You can tell him to make a claim with your insurance, and let them decide to pay or deny. You can tell him to make a claim with his own insurance, which (if they believe there is a basis to do so) will seek reimbursement from your insurance. You can ignore him and see what he does.
