    Default Property Rights to a Home Purchased After Divorce

    My question involves a marriage in the state of: California

    My husband is the breadwinner of the family and earns very well. I am SAHW. Two years ago I told him that I want him to buy a house, and he told me that his term is that we will divorce so I cannot claim this house in the future and that there will be no alimony. I agreed, we divorced (by default, I was served and just did not answer the petition), he bought the house on his name, no alimony, and we continue to live together as a couple.
    Now, I want to leave him, and I think that what was done is unfair to me. Is there anything I can do to change the court decision and get my share of the house and alimony?

    I'm confused. Are you saying you divorced before you bought the house and then you continued to live with him. California law doesn't provide you much relief. Sham divorces are still divorces. In not contesting the divorce you lose the benefits of being married.

    I don't get it either..a divorce for lousy reasons is still a divorce and CA does not recognize common law.....
    For that matter a homeowner has an eedited process under the CA LT law to exit a live in guest if you chose to squat past your welcome date...
    You made a lousy bargain...why do you expect legal system to unwrap same ?

    It is a real divorce. You are going to have to get a job and support yourself.

    It was a real divorce. It simply wasn’t the end of your romantic relationship. You knew what the deal was when you did the divorce — he was at least up front with you about that at the time. It’s a little late now 2 years later to decide it was unfair. Feel free to consult a California divorce attorney to see if you might be able to make a case for palimony or some other relief, but don’t get your hopes up real high about that.
