    Default Bench Warrant After Violating the Terms of a Diversion Program

    My question involves criminal law for the state of: Kansas

    Hey everybody.
    I was an international student studying in kansas from 2007 jan to 2012 july.
    I recieved a DUI in dec 2010. I went to court and was put on a pre trial diversion program since that was my first run in with the law. After a few months i failed the diversion program and i was told that the DUI charges will be brought back against me and i will have to go to court again. By the time the court date was set that was in july 2012 i had completed my degree and had to leave the US. Once i left the US which was also in july 2012 a bench warrant was issued with a bond of $25000.
    Also in May 2012 just a couple of months before i was set to leave the states i got a lewd and lascivious behavior charge. And before i could go to court for that i had left the US. This resulted in an arrest warrant with a bond of $1500.
    Both the warrants, the arrest warrant and the bench warrant are for misdemeanors.
    I had forgotten all about this but i recently got married and my wife is a green card holder and wants to apply for my immigration. After she mentioned something it got me thinking about these events and when i looked up my record online it shows the above mentioned warrants.
    I already contacted my attorney who handled my DUI cases back in 2010. The question i have is that after my laywer appears for me for the DUI case and gets the warrant quashed. Would i then have to face the DUI charges. And would i be able to pay the fines to get the charge resolved. How much can the court fines end up costing?

    It is highly unlikely that your lawyer is going to be able to get a dismissal of your criminal charge even if the warrant is lifted. You should discuss your case and its possible resolution with your lawyer.

    You really need to consult with an immigration attorney, but I am going to be brutally honest here, there is almost no chance that your wife will be able to successfully sponsor you with those charges against you...even if you get them resolved with fines. You need a frank discussion with an immigration attorney before you spend a lot of money dealing with those warrants.
