    Post What to Do if the Seller Leaves Personal Property in the Home

    What if you dont want the property? We just bought a house and took possession last thursday. The seller left some rather large items that will cost us to dispose of. Can we charge him for this disposal? What about storage?

    You are in what state?

    Why didn't you inspect the premises before closing, in order to ensure that the property was gone?

    Ohio. We inspected on Saturday and took possession on thursday. We were assured they were taking all of their stuff when they moved.

    The general rule is that once the seller gives you possession, the home and any personal property left behind become yours. If there is a chance that the seller will leave personal property in the home it is best to inspect prior to closing to verify that the property has been removed, or include a clause in your purchase contract requiring the removal of the property.

    Should have rechecked the day before the close or early on the day of the close, refused to close if it was still there, and stayed there and watched the stuff removed.

    Now, it's your problem. Period.

    From a practical standpoint, if the stuff is not complete junk, you can probably sell or give it away on Craigslist. That would atleast save you the cost of disposal.

    According to the rule, after the buyer take the possessions on a property then along with the property all the rest things are of the buyers. So, you can't charge any extra amount for this to the seller.
