    Default Holdback Dispute Over a Plumbing Problem

    My question involves real estate located in the State of: MA

    I sold my house last friday. We hadn't finished packing by closing so a holdback of $500 was in the closing doc. I had until Monday to move out. The buyer needed to tell lawyer that the house was clear in order for me to get the $500.

    She moves in Saturday and gives an ok by text to my realtor, meaning I can get my $500. Before I can get it on Monday she finds a small problem under the sink. She calls lawyer and or my realtor and complains. She wants part of the $500 holdback to pay for repairs.

    Buyer chose NOT to have home inspection. Lawyer won't release money to anyone until the buyer and I agree to an arrangement.

    I shouldn't be responsible for sink; she didn't want home inspection....

    What portion of the $500 does she want?

    Think of it as a continued negotiation on the price of the house and be done with it. Chances are that if it was discovered before closing you would have had to fix it anyway.

    I shouldn't be responsible for sink;

    How much are you willing to spend on litigation to get the $500 back?

    The hold back had nothing about the condition of the house, just my personal belongings. A lawyer I consulted with verified this.

    And when you asked your lawyer about possible next steps, was the price he quoted to represent you greater or less than the cost of the disputed plumbing bill?

    So the lawyer we went to for a free consult seemed to work. He made calls and I got the full 500$.
