    Default How to Stop Your Ex-Spouse from Filing Additional Claims

    My question involves a marriage in the state of: Arkansas.

    My fiance's divorce was final during the summer of 2014. His ex-wife keeps coming back asking for more and more money, and he feels like he has to oblige to satisfy some mutual debt they held. Now that he has MORE THAN fulfilled that obligation, is there some sort of legal document he can have her sign to ensure that she is not able to make any further claims? Thank u!

    The document that governs his obligations to his ex-spouse is his divorce judgment.

    Yes, but they made some verbal agreements after that settlement to try to remedy their debt. Now she keeps coming back for more and threatening to sue him. He is willing to give her one final monetary amount to try to end this, but I want to know if there is something we can then do to make sure she stops coming after him.

    He can tell her: "This is it. No more." Then be prepared to defend himself if she sues. Until he grows a pair and says enough is enough, she's gonna keep coming back.

    There's no law that says she can't ask for a gift, or that he can't choose to make a gift. She is free to ask him for money for whatever reason she identifies, and he is free to say "yes" if he feels like giving her money.

    As for whether she has grounds to "sue him" for something, we don't have the facts. The divorce judgment should have resolved issues of the division of marital assets and debts. If there is an ambiguity or omission in the divorce judgment that underlies the requests for additional money, your husband can consult his divorce lawyer about the possibility of having the judgment clarified or amended to resolve the problem. In the alternative, if there is such an issue and your husband prefers to stay out of court, he can attempt to negotiate a final settlement of the claims and have his attorney prepare a release of claims form that his ex- would sign in association with his payment of the agreed, final amount.
