    Default Getting a Job When in the National Theft Database for Petty Theft

    My question involves criminal law for the state of: New Mexico and Virginia.

    I was shopping at Kohl's in NM and I tried on earrings that were on sale for only $8 and walked around, searching for other earrings but I forgot I had these earrings in and walked out the store by mistake. Yes, I know that it's considered stealing and I 100% believe that I am at fault and am responsible for my actions. It was an honest mistake as I had gone to Kohl's earlier that week and had actually purchased jewelry of more value.

    I walked out of the store and was immediately called back and not until I walked back did I realize that I still had the earrings in. I immediately offered to pay and pay the full price, not the sale price but the security guy wasn't having it. They took me in, took a picture, and I signed a piece a paper stating that I would never shop at their store (to be honest, I actually have no idea what that paper said) and because the earrings were only $8, the police weren't involved. I believe that I was never cited. Or was I? Does anyone know???

    My main question is that now I'm in Virginia and I want to apply for a job at maybe a HomeGoods or Petsmart or something along those lines but I know that there is a National Retail Theft Database and I'm assuming that my name might be in there. Will new jobs that I apply for be apply to see this in background checks even if I may or may not have been cited? (btw, was 19 when this happened and still 19)

    I've definitely learned my lesson and I am more careful about my items and where I take them. Please help! Thank you so much

    The EL crystal ball is out being recalibrated. There's no way for us to know whether any given store will check the database, nor whether you are in it.

    Since the police was never called into question, that means I was never cited right? And since I was never cited that won't show up on my background check for a new job? That's my main concern!

    What shows up on any given background check depends on how deep and thorough a check is done. Just because the police weren't called doesn't mean no employer can ever learn about it. If you're looking for someone here to say it's impossible for an employer to learn about your theft sorry, but we can't in honesty tell you that.

    I agree, although its not going to show up in any criminal database because you were never arrested or cited. It could however show up in the National Retail Theft Database because that is not a criminal database. It is a database that is available to retailers who choose to participate in the database. There is no way to know whether or not Kohl's participates in that database or whether they would include people who they did not attempt to have arrested for shoplifting.

    I was reading on Yahoo Answers and I'm pretty positive that Kohl's uses the National Retail Theft Database. Let's assume that they put my name in, will a retailer like PetSmart which is not similar to Kohl's, use something like the NRTD? I could understand if HomeGoods uses that because it's more similar to Kohl's. Do you think that this indiscretion will cost me a job?
