My question involves criminal law for the state of: New Mexico and Virginia.
I was shopping at Kohl's in NM and I tried on earrings that were on sale for only $8 and walked around, searching for other earrings but I forgot I had these earrings in and walked out the store by mistake. Yes, I know that it's considered stealing and I 100% believe that I am at fault and am responsible for my actions. It was an honest mistake as I had gone to Kohl's earlier that week and had actually purchased jewelry of more value.
I walked out of the store and was immediately called back and not until I walked back did I realize that I still had the earrings in. I immediately offered to pay and pay the full price, not the sale price but the security guy wasn't having it. They took me in, took a picture, and I signed a piece a paper stating that I would never shop at their store (to be honest, I actually have no idea what that paper said) and because the earrings were only $8, the police weren't involved. I believe that I was never cited. Or was I? Does anyone know???
My main question is that now I'm in Virginia and I want to apply for a job at maybe a HomeGoods or Petsmart or something along those lines but I know that there is a National Retail Theft Database and I'm assuming that my name might be in there. Will new jobs that I apply for be apply to see this in background checks even if I may or may not have been cited? (btw, was 19 when this happened and still 19)
I've definitely learned my lesson and I am more careful about my items and where I take them. Please help! Thank you so much
