    Default H1b Approved but Got Fired While Waiting to Start Work

    Hi

    I have been selected and received confirmation I will get my H1B.

    I know the H1B becomes active from october 1st 2015.

    My company communicated me that my position will be terminated from 31 august.

    What happens now?

    1) if I find a new company can I tranfer the H1B beginning october 1st?

    2)Do I have to start the transfering process on october or in case I find a company, start it earlier?

    You can't really "transfer" an H1B. Your new employer files a new petition. You will need the approval notice from the earlier visa. You should be looking for a job and the employer should be starting the paperwork NOW. Your existing H1B means nothing for you to be able to work for anybody else.

    They should begin the process to revoke their H1B sponsorship of you. The timing of this is action is significant.

    My concern is about timing, let's say I find a company in june, can they start transfering (or call it filling a new one) my H1B so that since october 1st I can work with them?

    Again, there is no such thing as TRANSFERRING an H1B. Your new employer must file a new petition. The fact that you were previously approved short circuits some of the requirements when you note your existing approval on your application.

    START NOW. There is no purpose in waiting.

    Your existing approval means NOTHING for working for anybody other than the person for which it was approved for.
