My question involves labor and employment law for the state of: California.
I have just recently returned from a short term disability. While I was out my union entered into a new agreement which granted members a retroactive pay increase. When checks were disbursed I asked about my check and was told that I would not receive a check because I was on unpaid leave on the date the increase was approved. I attempted to get in contact with my union field office and found that my member id has been deactivated.
My question is I think simple. Although I was not in a paid status, I was not terminated. Does my employer have to pay me retroactively for the period I was active (roughly 8 months). What are my next steps to get this addressed.
